EcoLens Terms of Service

Welcome to Firley. All Firley software is provided by Firley ("we," "us," "our"). By accessing or using EcoLens (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

1. Acceptance of Terms

By downloading, installing, or using the App, you confirm that you are at least 13 years old and have the legal capacity to enter into these Terms. If you are under 13 years old, you must not use the App. We reserve the right to modify these Terms at any time, with changes effective immediately upon posting. Your continued use of the App constitutes acceptance of such changes.

2. Description of Service

EcoLens allows users to scan items in the real world to obtain sustainability insights. We utilize scraped data from third-party websites such as EarthHero, Earth911, and others. This data is displayed to users for informational purposes. If you wish to remove this data, please contact us, and we will address your request.

3. User Obligations

• Eligibility: You must be at least 13 years old to use the App. By using the App, you represent and warrant that you meet this requirement.

• Compliance: You agree to comply with all applicable local, state, and federal laws while using the App.

• Prohibited Activities: You agree not to (i) use the App for unlawful purposes, (ii) disrupt or interfere with the App or related systems, (iii) attempt to gain unauthorized access to the App, or (iv) transmit harmful code or malware.

4. Payment Terms

The App is currently provided free of charge. However, we reserve the right to charge for access to the App or its features at any time in the future. If we introduce charges, you will be required to pay for continued use of the App.

5. Waiver of Rights

By using the App, you agree to waive your right to bring any legal claims against us arising from your use of the App. This includes waiving the right to participate in any class action lawsuits related to the App.

6. Privacy

Your privacy is important to us. Please review our Privacy Policy, which details how we collect, use, and protect your personal information.

7. Intellectual Property

All content and intellectual property rights associated with the App, including text, graphics, logos, and software, are owned by Firley or licensed to us. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes only.

8. Termination

We reserve the right to terminate or suspend your access to the App at any time, without notice or liability, if you violate these Terms. Upon termination, your right to use the App will immediately cease.

9. Disclaimer of Warranties

The App is provided "as is" and "as available," without any warranties, express or implied. We do not guarantee that the App will be uninterrupted or error-free, or that defects will be corrected.

10. Limitation of Liability

To the fullest extent permitted by law, Firley and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the App, even if we were advised of the possibility of such damages. Our total liability will not exceed the amount you paid, if any, for using the App.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Pennsylvania, United States, without regard to its conflict of laws principles. Any disputes will be resolved through binding arbitration in Mechanicsburg, Pennsylvania, in accordance with the rules of the American Arbitration Association.

12. Miscellaneous

• Severability: If any provision of these Terms is found to be unenforceable, it will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in effect.

• Entire Agreement: These Terms constitute the entire agreement between you and Firley regarding the App and supersede all prior agreements.

• No Waiver: Our failure to enforce any right or provision will not constitute a waiver of such right or provision.
